We filed bankruptcy last year. My spouse wanted to keep a credit card so he didnt include it. Now it is maxed out and they are charging ungodly interest. What are our options? Can we just say we forgot about it? OR just not pay it. What would happen. Our credit is already bad.

    okay ... here is my best stab at your answer and i am NOT a lawyer. if your bankruptcy was already discharged (you wen through the process and you are done) NO you can't add it because there is no court proceeding to add it to. If you are still waiting for a judge to sign off on it then you can probably amend your papers and add it.

    as far as your credit being bad, if you filed bankruptcy a year ago the ultimate result was to get rid of your bad debt and start over. the reality is the bankruptcy is not what is going to be held against you in the future its the bad credit you establish(ed) after the bankruptcy.

    if you dont pay it they will go after you the same way they did in the past and either get a judgment against you or charge it off and wait for you to pay it. what i would suggest is you come up with at least half to two thirds and call them and ask them to "settle for less". at least this way when you apply for credit down the road you can say you thought it was included and when you found out it wasnt you settled the account.

    You ****ed up. You gotta pay! Since you left it out of your bankruptcy, you are liable. Your best option would be to negotiate with the credit card company for the best deal you can get. If you ignore it, it will just cost you more in the end. The debt will be sold to a collection agency, and their sole interest in life is making deadbeats pay. They are relentless, and you will wish a thousand times over that you had dealt with it sooner. You can't file for bankruptcy again for about six years, so you're stuck. In the future, do yourself a favor- pay cash! Obviously credit is not the best thing for you.

    Pay it, they will sue. One nice thing is that you should start getting tons of credit card offers. Find one with a low interest rate, transfer the balance and CUT UP THE OLD ONE. Pay off the new one and build your credit back up. You really need to examine the question you asked because it sounds like maybe you are not real good about debt.

    No, you cannot retro list it. The papers were filed and the court acted on that. . . there is no back button.

    Options ? Get your payments on track and have a card when you need one or don't pay and end up with no card as they will suspend it.

    Start paying on your bill and it will count towards having good credit rating
