US immigration. When someone has a tourist VISA and get married with a US citizen, can travel while the proces

If a tourist is in US and get married with a US Citizen. can that person travel outside of US, or she needs a special permit?

    American's are not jailer's, Dude! FFS! When you marry a citizen YOU are a CITIZEN of USA. This country lives, and dies on FREEDOM! You ever read any history books on that? Freedom is practically the first word uttered by American babies! Of course you can travel around the world! SHE"S AN AMERICAN, we pretty much do what we want, LOL. Have a nice trip, just don't let her forget to come back if she loves USA!

    The paperwork will not go through in three months so she end up as an overstay for the time being. MAYBE a lawyer will be able to do something but odds are she will have to go back for the time being. Whatver the case may be when you hit the interview stage you will be asked a million questions. How long have you known her... a few months won't cut it. Have you visited her country or spoken to her family? Do you have pictures of you two together on vacation? That sort of thing. If it is determined that something is iffy she will end up going home. You could get into some serious trouble as well. Since she is going home I would ponder if years of this and money is worth all of the hassle.... and being seperated for a long, long time. If you are really serious I would just go get married. Under international law any subsequent marriage is not considered legal. So poppa can't marry her off and will have to face that fact. The deal is done. He will be pissed but you will eventually be able to get her back.

    If they have already filed the green card paperwork, then the foreign national needs Advance Parole.

    However, if spouse entered on a tourist visa, hopefully they waited 60 days to get married, otherwise Immigration might consider that you committed marriage fraud by not waiting and using a K-1 visa

    Poor start!

    They should have come over on a Fiance's Visa as technically they have to return and their chances of returning, if from a former Russian state is slim! If I were them, I would not return nor would I leave the US until their status in the US is finalized.

    Fiancee Visa's are given to those who meet an American in their country and are allowed to come here for 90 days to see if they do want to get married. They do not have to return, which technically is not the case in your situation! Marriage doesn't mean a thing to the other country as people pull it all the time! That is why it is so hard to get a Visa from a US Embassy if you are between 18 and 40 and single for they know the odds of that person returning!

    you can marry in the usa but the tourist has to go home and wait in his /her country for the Visa process (K3)

    If he /she stays with that toutrist Visa in the USA he she is illegal. and if he /she moves out during that time ....she /he can get a ban .Why don't do it on the right way ?

    USBCIS recommends that you do not travel, during your I-485 pending period! If you must, you are required to file I-131 ( Application for Travel document) before your departure. Failure to file this form can result in your denial of re-entry into the US.

    Special permit, ADVANCED PAROLE, after the submission of the I-130 petition.
