Is this going to be called my fault? Hit and run victim!!!?

Yesterday I was involved in somewhat of a hit and run. A car tried to merge into my lane (where I was) I honked at him and he did not stop so I instinctively swerved so he would not hit me. I lost control of my car and did several 360's hitting several walls. Of course the guy took off. Good thing is that there were cameras on the toll road that I was on. The police office was very rude though telling me that if I was lying and the cameras showed something different that he would file charges against me and it would all be my fault. I told him everyhting that I remembered and to the best of my knowledge. How much detail could he expect me to remember after spinning in circles and screaming at the top of my lungs.

Anyway, just wondering if anyone has any experience w/ this kind of situation. I know go to the doc. and get a lawyer but I don't know if I should be worried about charges if something I said doesn't correlate to the video.

I am scared.

Don't get stressed out about it, as long as the fact that someone merged in on you causing you to have to avoid them and have an accident you have nothing to worry about. If you misremembered details about the car, situation, whatever, its really not relevant, you cant be expected to remember all the details after being in a traumatic car wreck. Depending on what happens you may need an attorney, but if there is video evidence of it happening, or of you and the other car in proximity any time around the accident, they shouldn't hassle you at all. Not to mention failure to control is the only charge normally assesed to a single car accident. He was probably trying to grill you to make sure you weren't filling a false report to try and get a not at fault accident for insurance reasons and or insurance fraud.

dont worry, even if they did decide to charge you, the worst it could be is for reckless driving.

make sure to call your insurance company.
