How old does a child have to be before they can decide whom to live with after a divorce?

I am in PA and I am thinking about getting a divorce (neither of us has been happy for years) My son is 14 and wants to live with me, but my wife would do ANYTHING to stop that from happening. What age do children get to choose whom they want to live with?

    its different from state to state..... ask your lawyer. or try calling a human resource department that is local. they should tell you. it is anywhere from age 11-13 i think. best of luck

    Judge's often listen to the kids at very young ages. It's the judge's job to do what's in the best interest of the child, and if a child states that they want to live with one parent, the judge most likely will give the child what they want. The wife will receive visitations, however, because its not in the child's best interest to never see their other parent. At 14, your son will have a great deal of sway.

    I think 14 is an acceptable age for children to choose. It's great that your son wants to live with you. Not enough fathers are willing to allow this. I wish you every success!

    At 14, your son is definitely old enough to decide that he wants to live with you. That is assuming that you are not an abusive or neglective father. Contact your lawyer.

    In Missouri, its 14. I know that really doesn't help you in PA, but ask your lawyer when you go and get a consultation. Each state is a little bit different, so good luck.

    i know in south africa, where i am living, the age is 9 for when a child is considered old enough to decide for themshelves which parent they want to live with. just check up on your divorce laws and see what they say.

    In ohio its 12...I'm sure most state allow them to choose around that age
