Auto accident w/ slight injuries. Other person at fault,what should we say to the Insurance Company ?

The young woman was cited for failing to yield/ran a stop sign. My husband was driving our car to work when it happened. After a few minuites he began to feel sore in his shoulder & neck. The Ambulance was called to look at his shoulder and neck area. They put ice on it & advised him take Advil. Now he is feeling pain & soreness. He is a server ,so he lifts & uses the arm to make a living.

This all happend on Disney property, in Florida.

So, what do you suggest we tell her Insurance company to make sure this is handled appropiately and we don't get taken ?

    I imagine that your husband has insurance. If so, don't say a word to the other parties insurance company and or their attorney. Let you insurance company handle the incident. Also, if there is the possibility of your husband having serious problems, it may be good to search for a good personal injury attorney. And make sure that the attorney you choose has a very good Private Investigator to work up the case.

    If the accident happened on private property, I don't understand how the other party was cited for failing to stop. Was a ticket issued?

    Get copies of any and all reports,witness statements...... You have to be your own advocate and not rely on others to help, help correctly or do your work.

    Was/is the ambulance operated by "Disney"? If so, they may try to down play injuries and or damage to reduce libality of their employer.

    You probably should tell them what happened. Unless you want to tell them the story about the 3 little pigs.

    Another hint, usually soreness in the neck and shoulders happens the following day, not a few minutes after accident. And since he was not taken away in the ambulance and given some ice and Advil, the same thing he would be given if he was walking and bumped into your own front door, there shouldn't be any fear of getting taken.

    Soft tissue damage is not like winning the lottery. Getting an attorney like many others here mention would be the dumbness thing to do.

    First of all, you need to go back to the doctor/hospital and get documentation and x-rays etc then you need to contact a lawyer. There are a lot out there who only make money if they win so you don't have to pay if they think the case is worth something. If you deal direct with the insurance company they will try to give you the least possible and get you to sign a paper that will prevent you from getting paid later if a more serious condition develops.

    Generally speaking, they will make the check out to you but they may want to make the check out to the auto body shop. Since this is not your own insurance company, I would imagine it would not be too hard to get the insurance company to make a check out to you. Good luck to you! Jason

    Hopefully you got the woman's information. Call your insurance company and claim an accident. They'll take your information..exactly what and where it happened. With the other woman's insurance company, you call them and see what they're going to do for you since their client was at fault. You can call their company and file the accident. (Most of the time they have no idea that their client was involved in one). But yea, just call your insurance company. They'll take care of you.

    just remember that submiting a false clame is against the law, but you should tell them exactly what happened and have a doctor look at it and submit whatever they find to your insurance. they should presue a claim from the other company. they may tell you to pay your decuctable and then they will get it back from the other person's insurance. but you should just have them go after the other guy.

    The truth .. that's always the best way to handle it .. one problem you may have though is it was on private property which might mean a law suit to gain compensation for injuries and damage ...

    don't tell them nothing get a lawyer they may ask you trick questions so you don't get any money that's why they get big bucks insurance company's don't like to pay out money
