No one has legal custody of her unless you are ordered legal custody throught the court. If she leaves with the child there is nothing you can do except get a lawyer and fight her in court! If you leave with the child she would have to do the same. What you should do is go and file for legal custody of your daughter without the girlfriend knowing this way if she leaves with the child you can get her back with no problem. Good luck.

Both of you have equal rights until you have custody papers drawn up! you would have to file through the courts or an attorney for help with that!
