Need help with divorce question in Canada?? HELP!!?

Ive been looking into gettin a divorce from my husband but whenever i bring it up he always says im not signing the papers if he doesnt sign the papers is there something i can do ?? i very much want this to be over im 23 and im completly misserable im tired of being in this situation i want to leave him and bring my daughter this isnt a good situation for her to be in either Plzz if any one has had this happen let me know what can i do to get him to sign the papers?? is there legal action i can take? I live in NB in Canada

    You can leave him and divorce him without his permission. I will include some links for you, for legal aid, and divoce questions and answers. All you need to do is secure a safe place for you and baby, even go so social assistace and explain your situation, they may be able to help you relocate if you have family elsewhere. DO NOT STAY if your home situation is unhealthy for you and baby, you don't even need a divorce to move away from him, and if he harasses you, notify the police they will issue a no contact order. That means he cannot phone or go to the place where you are staying. Here are the links.

    when i got my divorce the papers were sent to my ex via courier/registered letter. He didnt sign and return them, so the divorce was granted "uncontested" because he signed for the papers so he was aware that i had petitioned the courts and chose not to do his end of the agreement. Talk to a divorce lawyer, there should be some out there that will give you are 1/2 hour fee consultation (im on ontario). However we did not have kids. NOW...my friend who has kids, but was not married petitioned the courts for full custody of her son, and the father didnt show up to court, so she was granted custody because again, he CHOSE not to show up even though he was served with the papers. (different guy, not my ex lol) Good luck.

    First you leave....then you ask for a legal separation right away. It will secure what is yours and establish a child support for your daughter untill the divorce. They will serve him papers and he will have a delay to sign them. He can not get out of this, if he ignores the papers a judgment will be made and the money will be taken directly on his paycheck.

    Don`t try to negociate a divorce while you live with him. Leave first!

  • I've always been under the impression that after a certain amount of time, even if he doesn't sign them the divorce will go through anyways. I could be wrong though.

    Leave him. You don't need a divorce,walk out the door one foot at a time.When people talk about divorcing they are usually separated.Go see a lawyer you will need one.Not your husband's lawyer,your own.

    Sue him. Tell the court you want a divorce and your daughter and tell them how he's cornering you. Tell the court. Speak up. You need to do something about it. You should be happy! You don't deserve to be miserable!
