If you bought a warranty for it you should take it to whoever gave you the warranty first before you think about opening it up yourself.
I'm not tech savvy with the iPod but I think that it was designed so it would be difficult for you to get at the battery yourself.
Did you try resetting it (hold down the bottom of the menu button and top of the center button together for a few seconds)?

you cant take the battery out yourself....take it to the apple customer care service center...they will repair it for u...if it is under warranty
