My baby ate lead paint?

When I signed my lease agreement, my landlord had me sign some papers on which she stated there was no lead paint, or lead hazards in the apartment. I called poison control when my 13 month old started scraping his teeth on the window and eating the paint chips, just to make sure the paint wouldn't harm him. They told me it wouldn't unless it was lead, and I assumed it wasn't because of the papers my landlord had signed.

Well, just to be sure, I tested the windowsill myself with a home testing kit, and sure enough, it tested positive. I'm really pissed! They lied to me!I would not have moved into this apartment had I known there was lead paint. I try to stop my son when I see him doing it, but we have 13 windows and anyone with a 1 year old knows how difficult it is to keep them from doing anything. For now I have packing tape over the sills.

So I guess the question is :What do I do now? I don't want to sue or anything. I do expect them to do something about it though.

Of course I called his doctor. He's going in to get tested on monday. Thanks though.

    First of all, you make sure his pediatrician knows so he can be properly treated. Then you get the rental inspectors involved. Don't be surprised if you have to move. Your son's brain is worth more than the hassle of moving. And the dust can affect adults.

    you aren't going to sue when you have paperwork from them that positively states there is no lead present... get the paint tested in a real lab, and report results to housing authorities... you're in one of several apartments and you alone have 13 windows, you already 9 ahead of any apartment I've ever rented! Home tests are not accurate enough to give you much more that a guess as to how much lead is in that paint... all it does is what it was designed for: react to the presence of lead... just like home pregnancy test, it reacts to one thing and one thing only and the body only has that thing when female is pregnant, hence it can tell you you're pregnant, see the comparison?

    You will probably wait a long time for them to do anything about the paint... you will probably either have to strip and repaint these windows by yourself or hire it done, neither of which they will offer to reimburse you. Or, worst case move and turn them in after you are out of there.

    Something needs to be done about the landlord. I'm sure it is against the law falsifying a health risk. Call your local police station and talk to a detective. They will let you know what to do.

    Hopefully you will be able to have the lead paint corrected.

    It might be best for the baby for you to move.

    You need to report them. They have laws to protect children, as this is a known heath hazard, especially for children under 5! can cause learning problems etc. Have your childs lead levels checked at the doctor, they have something they can use to rid the body of excess lead. Also pursue with getting the landlord to repaint, not just in your apt. but in any rentals he owns, before more children are put in danger! If he brushes you off, pursue this further, with the county health Dept.

    Regular indoor paint is non-toxic once dried, so it shouldn't be a problem. Yes, it could be possible he had an allergy to an ingredient in the paint, but if the hives are going away, then he should be fine.

    Umm, take him to the doctor , now! If the baby has been ingesting lead, even in small amounts, there is a very real danger there of death or other problems.
