I hired a man to do some work on my house. He actually damaged?

my home and left it unfinnished. We are going to small claims court on Dec. 13th. I understand that if I win that does not mean that I will actually get money from him. Unless he sells something. What other actions can I take.

    OK, assuming you win your court case and the handyman doesn't pay, you would then have to petition the court to enforce your judgment. An enforcement order can have the court: 1) garnish his wages (this assumes he has an employer); 2) place a lien on his property (car/home); or 3) have the sheriff seize property and have it sold at auction (this rarely happens).

    Now, all of this will cost you some $$$. You will need an attorney who will most likely charge you by the hour ($300 to $500). So, depending on how much money this guy owes you, it may not be worth going after him.

    You may have another option. If you have homeowners insurance, you may be able to file a claim with them to cover the damage this guy caused. They most likely will want you to sign a subrogation agreement or/and assignment of your cause of action. Basically, this means that you agree to pay the insurance company back if this guy ever pays you (subrogation) and/or that you agree to assign your case (the insurance company stands in your shoes) to the insurance company so they can go after him. You'll have to contact your insurance agent to see if your policy covers this type of damage (I've seen both, some do, some don't).

    Most states have a lien process. It means that you will you will have a legal right to money proceeds from his business that he must pay once he sells something. Sort of like when the electric company places a lien on a homeowner who is selling their house to get the money for unpaid electric bills.

    Lien obligations must be taken care of from any sale of assets before the old owner can take the proceeds of the sale of that asset.

    if he's a poor handyman type without insurance you are SOL

    you really take youre chances when you hire a cheap contractor, make sure next time you hire some one that has a good reputation and is insured (get a card from thier insurance carrier)

    I kinda thought that sueing someone ment there would be a cash settlement discussed. If the man in question does not possess any currrency, then you should "gank" some items of material value, as in his pets or loved ones. If that isn't good enough for you people, then try getting his soul.

    Depending on the state there are companies that will "purchase" your award and give you money and then they use their professional skills to hound him for the rest of his life until they get the money. You should be able to find some on line, but it varies by state.
