If you enter a hospital clean of infection and contract MRSA , shouldn"t the hospital be liable?
I have had a myriad of problems for five years, including loss of mobility and body parts.At that time they had no idea what MRSA was.Now it is a big deal because everyone seems to be getting it.

Well that depends...
If we are out in the grocery store and someone sneezes or coughs on us... do we hold them liable if we get a cold or the flu?
It is an ethical question up for debate and it all depends on how you look at the situation.
As a rule, every healthcare worker should wash their hands frequently between every patient and after every patient... If they don't do so... you could say they were acting negligently, and they should be liable..
However, since 1% of the population is colonized by MRSA ( this means that it lives on the persons skin but does not cause symptoms or make them sick ) they could wash their hands as they are required to... but even with very thorough washing, some MRSA could still be transmitted. So does that mean that person acted negligently, even if they followed guidelines?
I am open to hearing opinions. I would like to see what others have to say... Hopefully we will get educated responses. Ive seen alot of immature responses on this forum... so we'll see.
P.S. to the poster named freeia.... the infection is called C-Difficile... it causes Diarrhea... It is typically caused by Antibiotics... After surgery and before surgery, you will get antiobiotics to prevent infection.... As a side effect of the medication... it causes diarrhea.

no it isnt anything anybody can help A lot of people are carriers of it that dont even get sick and they can pass it on to other people who may get sick. You can get it from walking in a store. No one would be liable.

My mother contracting e-dificil (sp?) after an operation at a hospital she worked at. It can only happen through contamination by fecal or blood matter. According to her you sign a waiver before any surgery that releases them.
