Collecting Court Judgment from Disability Person?

I have a family member who won a small claims court judgment against a person who doesn't work, only collects disability.

Part of the damages were to cover replacement of the destroyed object, another part was for harassment (emotional damages? Not sure).

My question is; this person boasted that judgements can't be collected from a person's disability (the guilty party's only source of traceable income), and thus, will not have to pay the consequences.

Is this true?!?!

    the only time disability is garnished is for child support and the IRS

    but if your friend takes him to court for non payment and they place a contempt charge on him he may have to do jail time and then maybe he will pay up but like stated above the hard part is acually collecting

    i remember my parents won a very large law suit agiants somebody 25 years ago and have never seen a penny from it

    Collecting money from a judgment that you won in court is very difficult, unless people or a business have a regular income or significant assets. The Goldmans won $35,000,000 from O.J. Simpson, but they have never been able to collect. However, you have some powerful information. Collecting disability while they are not disabled is a major crime. All you have to do is video them doing things that are not supposed to be able to do. You know they work, so video them working, or coming and going to work. Every person with a fake disability wants to still do the things they are really able to do, like lift something heavy when they need to, or go play sports, or walk or run without showing their disability. Just video them. Then turn it over to SSI investigators and to the local TV station. Warning: Do not ask the "disabled" person to give you money so that you will not reveal the video, because that would extortion.

    Depends on the state and who is paying the disability payment. But generally true. U.S. Social Security disability payments cannot be attached.

    Sorry, disability payments are exempt from court judgments.

    Sounds about right to me. Winning a judgment is the easy part, it's always much harder to collect.
