Just saw on Yahoo that sex in a public restroom is private according to the ACLU, How?

OK, I believe in the ACLU most of the time, but a "public" restroom cannot be private, that to me is condtratics itself, What do you think?

    lol I love questions like this I am not sure about that one maybe in a gas station bathroom or sams club becasue they are unisex? who knows maybe check this site they may have some info

    These issues are a matter of legal definition, for disparate situations.

    Whilst, for the definition of the crime/misdemeanour of sexual activity in public, the restroom might be classed as a private place, it would not be relevant to a charge of "Offending Public Decency".

    If an innocent bystander makes a complaint against a publicly copulating couple, whilst using the "private" place, then the definition has no standing.

    This is a well documented precedent in English and Scots Common Law, upon which American Law is based.

    The ACLU, at times does a wonderful job at protecting the civil liberties of our citizens.

    In contrast however, they sometimes do more harm than good by being over zealous in their civil actions.

    It does little good for a dying patient if the doctors fight over a remedy.

    Obviously you are entitled to a moment or two of privacy in a restroom for obvious reasons. When someone abuses that privilege, they forgo those civil rights which may protect them.

    I'm with you in that I'm generally a supporter of the ACLU. I get annoyed by the constant, unsubstantiated attacks by the right on that organization. However this defense tactic seems kind of lame.

    the ACLU is wrong 95% of the time. This time as well. It's a PUBLIC restroom.

    I haven't seen the question as yet, but there may be a "reasonable expectation of privacy" in the stall, but not in the public area, of the restroom.

    Well, I don't believe in the ACLU in any way, and I saw this story and just laughed my *** off.

    They just get more and more ridiculous every case they take.

    public restroom is the most private place in public area. it is ironic but believe me it is.

    I would have to agree with you.

    If you are under a towel on the beach, is that "private?"
