Does a Man's children have any legal re-course if he dies & leaves no will, and has a present wife?

Children's Father died, leaving NO will, but did leave wife 6, in the state of Michigan. Does this wife get everything, or does the children have any rights?

Update:

He died in the State of Michigan; children are in Mich, NV, & Fl

    It may vary by state...... ask a lawyer.....

    I think the wife gets a portion......... government gets more.

    Usually, if a person passes away intestate, then there is very little recourse for the family--Everything goes to the estate, that will be controlled, now, by the government. I know that these things vary state to state, so you would have to check with your lawyer. Good Luck.

    I think most states go .. BY LAW .. if there is no will..

    i think that generally means the wife first.. then children

    you can probably find the law for your state by googing it. and see for yourself

    if the estate was extensive.. there might be some items that would go to a child.. yu'd have to confer with a lawyer.

    I don't know about your state. In mine (Alabama), if a man dies without a will, the estate gets divided equally between the wife and the children.

    If the children are grown, it's most likely that the surviving wife gets everything.

    they can have rights, it varies but its a long arduous legal battle...so talking to a lawyer about wehther the payoff is worth it in the end is the key, after they get done paying legal fees and court costs

    when my hubands mother got killed in a car wreck,her present husband got the house because she put his name on it but the boys was heirs and got part of the life insurance money.they did get a lawyer though,but thats all they got. you will just have to contact a lawyer and see.
