Would a teenage boy go to jail if he were to have sex with a teenage girl? (same age say)?
I am ONLY asking cause (roll your eyes now) I just saw a 20/20 commercial and it was about what parents (everyone really, i imagine though) really understand and dont understand about the law of consent.
So, I am just wondering, if for example a 16 year old boy and girl had sex (and it was concentual-not a case of rape) would the boy go to jail or face jail time, and worse have a record his whole life (how would he potentially face charges-say the parents walk in and freak out and call the cops-i dont know- you make that up, I just would like to find out what would happen)?

The law does not consider teenagers under the age of 18 to be capable of consent. Laws of statutory rape apply. There are so called Romeo and Juliet defenses in some states, but that does not mean that they, usually just he, will not be arrested and jailed. Just that they will have a defense if he gets caught and prosecuted. The exception is if they are married. For example in some states a 16 year old boy, or a man of any age for that matter, can marry a fourteen year old girl and they are protected. I do not think that a boy can marry under sixteen in any state, but I have not looked that up. The prosecutor decides who gets prosecuted not the people involved or their families.

the answer to your question is no, actually depending on the state if he was 18 and she was 16 he would not get in trouble either some states allow no more than a 3 yr difference in age and there are other determine factors...besides the girl woudl have to go to jail too..

I am 16 and have done it about 10 times and am here typing this letter - as for the parents freaking out - yeah im sure i would be groudned for the rest of my life at home if they knew...
A lot of kids at my school have done it and do it often and i have never heard of anyone going to jail for it.

Being under the age of consent only applies to having sex with someone over 18. Two underage people can have consensual sex and there is nothing illegal about it.

If everything was just as you said (same age & consentual) more than likely, nothing would happen.
On the other hand, mutual consent wouldn't matter if one of them was impaired & not in a condition to make the same decision if sober.

no. this isn't something that a boy automatically gets charged with. the same thing can happen if a woman has sex with a minor boy too. i have seen that happen.

no, otherwise they'd both have to go to jail because he'd be a minor too. girls aren't allowed to commit statutory rape either.

no, he wouldn't, it was concentual, and either is 18 or over, parents can't do anything
