How many days has it been since you emailed and haven't gotten a response? Perhaps try messaging him again to let him know you're seriously upset.
I use eBay often, sometimes it takes a while for items to be sent. One time when an item wasn't received however, I got a refund automatically. Another time when the product wasn't described as how it actually was, I issued a return/refund, sent the item back and got my refund. Ebay is pretty good at trying to keep things under control and keep people happy. When I did the return we had to go through ebay where they give you a specific worker who works with your case to make sure everything is set out.

Yeaaah if the seller didn't respond (jerk!), it's better to file a dispute. If you paid with Paypal, eBay will trransfer it to them. Basically, they ask you WHAT are you filing for (i.e. was the item defective, was the item broken, did you not receive the item, etc.) and to describe the situation a little more in detail.
THey'll notify the seller, and either the seller will communicate with you why/when he will ship out your item, or if he will give you a refund, or in your case be a jerk and not say anything.
I just had a bad experience like that not too long ago, and the seller didn't respond ever, so Paypal forcefully refunded my money back from the seller's account :)
GOOD LUCK!
Message me if you need help, although eBay has a live chat support, it's on the homepage :)

Hi there! I would strongly recommend that you try contacting him via phone.
To get your seller's contact information, including the phone number, please follow these steps:
1. Click the "Advanced Search" link at the top of most eBay pages.
2. Click the "Find Contact Information" link on the left side of the page.
3. Enter the seller's User ID and the Item number.
If there is no response from him after 7 days since the transaction ended, feel free to open a dispute in your My eBay page. If there is still no response from him in the dispute after 7 days, close it and file for refund.

Don't file feeback at all until you have filed an "item not received as described" complaint. They will expedite the refund of your money if needs be. Negative Feedback just gets negative feedback in return. Unless you have an absolute ton of feedback, don't give anything negative unless and until you can take the hit yourself. It's just the way e-Bay works is all, plain and simple.

There is no amount of time that you HAVE to wait. I would contact ebay and tell them about it and they would let you know what to do, and you can possibly get your money back.
