Yes, that is if you haven't actually purchase the song. People consider this like roms, can't download it if you don't own it. However Galbadia Hotel states if you have the game, then you can download the music. Not sure if this applies to every song, but still risky either way. Check it out at the following:

And KHinsider really states that you can only download the song if you actually own the song. As you're probably aware of, before your download, some text reminds you and states that you are in fact "agreeing" to their terms and cannot be responsible if you get caught.

So, just to sum it all up from my view, don't download a song if you don't have the game in which it came from. Remember, the same music is on the game you bought, so these sites provide a way for you to enjoy what you bought.
