I need your Advice about child support?

I am not a dead beat parent; It's just that today I got paid and child deducted 90% out of my paycheck; My pay after taxes were $191.00 and child support took out $115.00 Leaving me

with a weekly paycheck of only $76.00

Is there anything I can do to get them to lower my payments

Update:

I have four grown kids now my oldest is 26 years old and my youngest is 22

Modify at your CS, that happen to me in 1998 my first born.

    Not exactly the same but

I was part time at yale university but its was and should be against the law to take out 90% of your net pay. If your 200$ a week they should be the ones to receive 76.00 and you get the 115.00

I was getting 115.00 a week when i was part time, for one child, until full time became 95.00 a week / 80.00 a week support payment.

    They cant do that.

Modify with the clerks office in a high (Superior) court or seek where you can make the modifications. Let them know whats going on with you and your expenses.

Hi, been in your boat too. Child support will take 50% of your pay as support and in Michigan, 15$ per case late charges. It looks like you were hit like me. My support in Michigan can only be changed every 3 yrs. As for all of yours going towards arrearages there maybe a way: Contact in writing your caseworker, and ask for a hearing. If you are in your alloted time to change, get the hearing and all your past income statements and insurance charges. Show all your other bills, the judge will be looking for a oddball payment for a luxury item, If you have one, make sure they understand it is for sale to pay arrearages. That's a start. thats is what I learned. I have 6 kids and 8 years to go. I am not rich, but now everything is stable, and my kids want to visit me all the time! They also call all the time just to chat. Thats whats important to me! Good Luck. LD

What state do you live in?If all of your kids are grown why are you still paying child support?Do you owe back child support payments? Here in Texas when a child reaches the age of 18 the child support stops. If I were you I would definitly look into this matter. If you are making less money now than when you were order to pay child support I would go back to court and let the judge know that you are making less money and the judge should make your payments lower.GOOD LUCK!!!!!!!!!!!!!!!!!!

I'm assuming that you owe arrearages, and I'm also assuming that those arrearages were set when you had a higher paying job. What you need to do is file a motion with the family court to modify child support. You will need to bring 3-4 pay stubs with you, and they will reduce the weekly amount.

    Good Luck.

If you can show your pay has substantial changed and due to things not under your control you are making less money, you could go to court and ask for a lowering of support. But there are many things involved in this and an attorney would need to look at your particular situation to see if yours would be one that could be lowerd.

What state are you in? You can always request that child support be lowered, but, the liklihood of success depends on the state laws.
