if he owes back child support and is paying back and current out of his paycheck, will the rebate check be?
reduced or will the whole thing go to child support? if reduced will it be the same amount as he pays from his check( 17%) or 17% of rebate? or how much. when we first filed, they said child support had nothing to do with rebate, but when i went to irs website it says check may be reduced for child support

The only way they will take the rebate check is if he owes at least $500 in back support. If he does owe at least that, then it does not matter that he is making current payments, they will still take his rebate check to go to back support. They will take up to the amount owed in back support. So if his rebate check is $600 & he owes $500, then they take $500 for the back support and give him a check for $100. If he owes more in back support than his rebate check, then he gets nothing. But this will only happen if the office that handles your child support case has asked the IRS to do so, the IRS will not do it on it's own, & his rebate check may not be sent out at the same time as yours. So you won't get his rebate money at the same time as yours, if you are going to get it, it will be sent as a seperate check from you child support office, not from the IRS.
