Accident while test driving dealers car, Please help?
Hi there,
Almost 2 and half years ago I had a car accident while driving a dealers car, crash into a pole.
The salesman is suing me because he was slightly injured and the time he didn't go to work. His lawyer is asking for my insurance information, and I have not presented any information about my insurance.
Am I liable for this claim, or dealer's insurance has to cover up the charges. I am a student and do not have any penny to give if they even win the case.
what advice do you give?
The statue of limitations in CA is 4years for written and 2years for oral.
I was age 18 when test driving the car, and he really was trying to make a sell, he asked me to push the car to the limit and I forgot to say that on the police report, because I was scared.
I have appointments with lawyers Monday and Tuesday, but Lawyers are expensive to work with, I don't know if it is possible to get an experienced lawyer for minimum amount as possible. I am student again, and have hardship from student loans already.

first, do not give them a single piece of information until you have consulted your own lawyer. Do not say a word about the accident or your insurance or anything. They will be recording your calls and be very willing to use whatever you say to their advantage.
Secondly, I went through this, got into an accident and the passengers in the other car claimed they were injured. Get a lawyer on it, when I did I found out that it took them 3 weeks to go to a doctor and the doctor found fresh bruising which they are trying to use against me but it clearly did not come from my accident. It is quite possible that this man never saw a doctor and just thought he could get a few days off work for it.
The best advice for the entire situation...get a lawyer before anything

Its been 2 and a half years ago- pack your bags and leave town. If the guys coming after you and talking nonsense, just call the cops and say that he's harassing you. And either way, if you were under the age of 21, then he had no business letting you drive in the first place, and it would be solely at the salesman's discretion. They have a right to not let you drive if they feel that you are too young, but if he just wanted to make some commission so badly that he decided to put his life at risk, well then its his fault.
...by the way, that's awesome- crashing a car on a test drive. LOL

I would go see a lawyer. Personally, I would think that the car would be covered by the dealer's insurance, and so would the employee. If you don't have enough money to pay for a lawyer, there should be legal assistance available for free, or low cost. You may want to see your school counseler to get a lead. But if the salesman is all lawyered up already, you need to get that way too.

First of all, what state did this happen in? The statute of limitations (time to make a claim) could have possibly already passed.
Secondly, have you filed a claim w/ your insurance company? If not do that RIGHT AWAY.
Then provide the other party w/ your insurance company name, claim #, and adjuster information.
Or tell them that your company will be calling them.
Thirdly, if you do not have auto insurance, the dealer is more than likely self insured. Any injury claims would be made on the dealers auto policy.......... but technically yes, you are liable

the man was at work at the time in a company car. this falls under Workmans compensation insurance. You were a customer ''invited '' to test drive the car,,,,which you did not own. His lawyer is nuts and trying something that has no merit.
If he were crazy enough to try to take you to court,,,the judge would throw it out. then you would have to sue him to collect your court costs..
The whole thing is rediculous,,ignore him,,,,,totally.

No you are not, the time for this guy to try and pull this has passed, its two years from the date of the accident plus how is he going to prove that his injuries are from that accident........

This is a tough one. I would not neglect it, consult with a lawyer, it may cost you but you may avoid bigger expenses down the road.
