Child Support in Calfornia?

Hi,

my son's mom and I are separating. We are having the baby 50/50. We live in California. We got together 3 years. Do I have to pay child support? We are going to write an agreement and sign it that she is not going to ask for any welfare in the future. Would that cover my back?

please advice.

Hi thank you for your response; we will have him 50/50. I will have him 4 days one week and 3 days the following week and so on. We are going to write an agreement that she is not going to get welfare or child support, we are going to write on paper and sign it. Would that cover my back?

    If the mother petitions the Court you will have to pay support like you two were married - if you are the father you will have obligations for the child.

    The agreement being signed sounds like she won't ask for support or do you mean alimony?

    It will need to be established who has physical custody because you each having the child 50% of the time will not work when they are in school and aging. Though the amount of visitation the non-custodial parent has with their child is in no way related to the amount of support ordered.

    She does have a right to get support from you though. But if you have the baby 50.50 maybe you two could work out an agreement outside of Court where you pay her $50 a week or something...

    The agreement would NOT cover you. She has a right to seek support - you are the father and if need be she can collect money from you to support the child.

    who will have the baby most of the time? if its her, then no matter what she tells u she can get child support wheneevr she feels like it. when my parents split my parents mutually aggreed they wouldnt take it to that level.
