If you're asking if you need her to apply, then yes. If you're under 18 there are certain forms she may need to sign, but for the most part you don't need her.
If you're asking if you need her to GO with you then the answer is no.

I moved away and started college before I turned 18. I doubt any police officer is going to force you to stay home until your 18th birthday. Especially if you have graduated from college and have your bags packed to go off to college. lol
You do not need your moms "permission" to apply and attend to any college you want. It is a free country, after all.
However, unless you have a big bank account to pay for school, you are hindered by what you can borrow on your own without her taking out a PLUS loan to help fund the rest of your education. Any school out of state is too expensive for a student to fund on their own.

There are ways around it. To pay for college, you need her, unless you've thought of other options to pay for college, i.e. loans, financial aid, etc. You can apply on your own, the only thing you may need her for is the "residency form" but if you call the school and let them know your mother is not involved in your college decisions, they will let you know what to do from there. The main thing is money, living, etc. If you can handle that stuff without your mother's help then you'll be alright. But if she is not willing to help you pay to live there, you'll have to figure that out. Good luck!

If you're over 18, you can do what you want. If you are under 18, you can go to jail for forging her signature, but that's only if she pursues it. Would your mom put you in jail?
