Leopard Upgrade vs. Leopard Install DVD

I bought a copy of Leopard from eBay under the claim that the disc was a full installation version. It turns out that the seller wasn't too honest and this is an upgrade DVD. The installation procedure checks for the existence of v10.4 prior to beginning the installation. I have v10.3.9. Before registering a complaint with eBay and PayPal, I'd like to know if there is a way around this check. It seems like there is a hidden file on the DVD called "CheckForOSX" that prevents me from proceeding.

    I'm no Mac expert, but any upgrade disc should only have the files necessary to upgrade from the oldest system it supports. Sorry, but if it checks for v10.4, it can't install unless you have at least that. I hope you can get a full refund and buy the real install disc.
