Is this legal, if not where can I get help? ?

My mom bought some things of a furniture store (Casa Leaders) under credit and she hasn't been able to make monthly payments because of financial troubles. Thus they have started to dip into my mom's bank account (WaMu) and take money to make their payment, resulting in an overdraft for my mom and taking money to pay something very important. I was wondering if it was legal because they did not have permission to do so and the first time they did this my mom told them not to.

    I work in Credit Control; they could not gain access to your mothers account without her concent, so she must have signed somewhere :(

    Your mother really should have called prior to the payment becoming due to negotiate a repayment plan, wich is what she will need to do now, she will have to ware and fix up the overdraw as it was her responcibility to have cleared funds. Sorry for the bad news, just make sure she calls them from now on when theres a hassle!

    Do you know what the terms of the contract were? No bank in the world is going to just let people remove money without authorization. Your mom's money problems are not the furniture store's problem - what she needs to do is go to them and see if she can negotiate a settlement for the return of the furniture.

    I believe you'll find that your mom didn't read the fine print when she opened the account with the furniture store.

    No, it's not legal since they did not have permission to take the money. However, having said that, I'm curious as to how they got your mother's account number? Your mother had to have given it, which means she may have unintentionally given permission... I would call a lawyer and file a suit.
