What do you think will happen, What have I done!!? We have both signed our Divorce Judgment.?

We have finally finished negotiating our divorce settlement. We did nearly all the negotiations ourselves with some guidance from our separate lawyers. (we have a 52 pg prenuptial agreement that his current attorney wrote 7 years ago) We live in Oregon. The last paragraph in our prenup says that husband shall pay wife pre determined judgment amount (set amount per each yr of marriage) less 50% of marital assets. Well, neither he or his attorney who had written this paragraph caught on to this word "less" After we both signed, me on Wednesday and him on Thursday, Friday morning in an argument, I spewed out that his attorney is an idiot she didn't even pay enough attention to her own writing bla bla. Well later that day when i saw him, he was FURIOUS! He says he has been cheated out of $90,000 dollars, $75 of it half of retirement valus for the 7 years, and he'll make damn sure that his attorney recovers this for him through a malpractice suit. I have opened up a large can of worms with my big fat mouth. My attorney called me later that day and said there looks to be an investigation. His attorney says it was unethical of mine not to point out the error. But we really did the negotiating ourselves.. Does anyone know anything about this kind of thing. I feel like he has signed this thing that we worked out and was ok with it. Can it be undone. Please no comments about my loudmouth, I already know..

Update:

The man is wealthy, very wealthy and I raised his kids for 16 years. This mistake is nearly half of total settlement..Who in their right mind would have pointed this mistake out before hand?

What are you suppose to do his lawyers job for her? She is the stupid one who should have to pay the price. His attorney will say anything to make you look and sound bad, but she wrote it. He should sue her for not doing or knowing how to do her job not you and the way I see it he knew what he was signing and he should get over it and learn from it. It's not your fault both he and his lawyer is stupid!!!

Trust me, you won't be upset with me but I *am* going to say something about your big mouth because I've been separated/divorced since the beginning of 1997 and our most recent court stuff finished about 2 months ago and that's why I think what I think.

Okay as I understand it, you knew the other side was wandering down the wrong path and didn't say anything.... well, I quite possibly wouldn't have done so either, so no judgement from me on that one. It sounds like your ex may be like mine in some ways and so I would probably have kept my mouth shut on the basis of the mistake being fairer than what was in the prenup which might be the case for you.

But now about opening your mouth... there's a really strong chance that if you hadn't, sooner or later he would have figured it out himself and then he would have started his "little" tirade and crusade anyway. At least this way you don't have a time bomb hanging around, wondering when it's going to blow up. You've probably done yourself a favour and will look back one day and realise this. Reason I feel so sure of this is that my ex has been prodding and pushing and dragging me off to court whenever he finds something to do it over and it gets really wearing and depressing and stressful. The youngest was 1 when we separated and I have another 5 years of my ex being able to drag me off to court and stuff me around with maintenance. Because this has come out now, you'll be able to get it out of the way earlier (if he drags it to a judge) and be rid of any attempts to harass you sooner. So don't feel bad about what you did if you still are... it probably would have come about sooner or later anyway.

All the best and I hope whatever way it goes, it's over quickly for you.

Patricia Schiff Estess has some books on marriage and finance-

but I read a bool once that even if you sighned a prenutptual agreement

that after so many years and depending on the financial situation prior to getting married and plus what was brought into the marriage itself during the marriage are all factors a judge can ponder on.

In some cases prebup were ignored if the marriage was over 5 years but in cases where the marriage was less than 2 years it was implemented.

Plus you should have both read the agreement prior to signing-

what's that saying about ignorance and the law?

I wish my own mom was as lucky as her divorce is going on for over two years.

Otherwise- it is very possible that if your husband does try to go to court he himself is opening a can of worms that would still possibly beneit you even more- as there are so many aspects to this...

I am so overwhelmed by what you'vee just written. Even though you didn't mention the one thing I feel sure of, is that, you were probably eaten alive by the whole thing. I am convinced, that, you are one hell of a good person. Thanks for being you and sharing this story.

If you weren't an honorable person, you wouldn't have mentioned it. I think he owes you a big apology and a thanks. I can bet that you are still his only true friend.

I think they all should view this differently now that you came forward. You are a stand up person and I'm glad that you got the chance to show and prove your true colors. A good judge should, and I believe will, do right thing considering the circumstances. If not take the bite, it's worth every cent.

As said above, his lawyer should bite the bullet. You are so cool.

it normal for men to get very angry or upset when they have to give up their assets. They make us feel guilty too but the thing is that you were married to this man and the law is what it is. You are entitled to whatever the law states and he can make you feel guilty as much as he wants. Its not your fault. I went through that 6 years agowith my ex and he tothis day never got o over th fact that i recieved a large sum of his money that he worked for all his life. I dont think they take things seriuosly when we take our vows together at the alter. If you have children, you will need this money to survive and start over in life. Legal fees are expensive too. Im going through another case right now where my bf is now angry b/c im taking him to court for child support and custody rights. He has to pay me a large amount of cs every month due to his income and he's angry and upset and doenst think its fair. His first child! I am feelng very guilty about my decision but i have tothink about the baby and the kind of life she deserves. Our choices sometimes arent always the best for some people especially when money is involved. Keep your head up high and ignore all the negative comments he or others may say to you. You were both in the relationship equally for seven years. Take what is entitled to you.

this is one for attorneys only really!

Sounds long and expensive! But if attorneys signed off the papers the end of the day, surley they are the experts who get payed a FORTUNE to make sure every word is correct.

Joe average would not understand half of it?

Let thelawyerss sort it , it`s not your faults, you pay them to sort out the details even taking advice when to sign.

If i collect my car and sign that the repairs have been done, and the wheel falls off and kills someone, can it be my fault ? even though i don`t understand cars? no, the garage has to sort it out, they charged me to repair it. They have a publicliabilityy insurance anyway for that, so has the attorneys?

It's not your fault. Let them settle it now...

But from my understanding, he can't be angry with you. You signed first and the him, he should have read the fine print...

Good Luck and I am so sorry that you are going through this!

he sounds like a spoilt brat boy who just wants wife and kids out of his life, so he can chase 20 year old brainless girls. you'll be better off without him honey.
