If someone has reported that his/her cell phone is missing/stolen, can the person who found activate it and use it, or do they have to unlock it?

If you called your company and suspended your account- then they should not be able to use it on your account and run up charges.
They can unlock it or replace the sim card and may be able to use it but it depends on the network.
Report it lost/stolen to your company A. S. A. P. to avoid any charges and restoring it shouldn't be a problem should you find it later.

There are two types of cell phones. GSM model and CDMA model.
In GSM model if the cell phone is stolen, the person can activate it by inserting another sim card. The service provider can block the old cell phone no. from its use. But the person who got this phone can still use with his new sim card.
In the case of CDMA phones the cell phone operator will block the phone from use. The person who got the phone cannot use it. It will be only a toy for him.
Recently the CDMA phones are coming with a sim card. In the event of loss, or theft it can be used with a different sim card. The service provider will bloch the old sim card from use. But the person who got the phone will enjoy using it with a different sim card.
Thus the high end models of hand sets should be insured now against theft. UNIVERCELL has started insuring
