Illinois-my sis is seperating with a guy after 6 years,2 kids, no rock,what should she do?

My sister has been living with a guy for six years, they have 2 kids(together) and she wants out because he, wont marry her and treats her like dirt.hes from turkey,she is from southern Illinois,can he take the kids?,he makes great money(phys therapist)she has been home having the kids,he wouldn't let her work,you get the general idea,if she leaves him what rights does she have.

    She should turn back time and not make babies with someone who didn't commit to her FIRST.

    Gather some proof how he treated her like dirt...like a video of how he treated him...if he's abusive in words make sure they're recorded as well...if he's abusive in sex then if your sister can handle that have to videotaped that one too (this part is optional though cause this is too private but an additional help in favor to her once presented to the judge)...etc...there are lots of things and ways on how to prove that her partner is not worthed to be living with...these evidence are also strong proof that he will never be a good father...once a man treated his wife badly then there's no way that he'll be a good father as well.

    When it comes to financial issue...through the evidences that she will provide...most likely the judge will rule the court to have the kids father support them until your sister finds a decent job and a decent place for her kids. As a matter of fact the financial support for the kids will continue until they're 18 years of age.

    (My suggestion though I'm sure works in US but if they live in Turkey...I don't know exactly how they do it by law but I suspect it's totally different)

    If he gets them out of the country, it will be a long hard and expensive road, and that's if she can even find them. This will be really tricky because the court will rule for visitation and then he will have every opportunity. Seriously, it that was me, I would go into hiding.

    i also live in illinois, and since they were never married until he takes her to court to get any visitations or rights he has none!!!!

    In the state of illinois if you are not married the mom has assumed sole custody of the children. talk to any lawyer and they will tell you the same...tell her to get out, and why would she want to marry him if he treats her like dirt?

    Do they have passports? If so, she should get them in her possession and HIDE them. It's unlikely that he could get them, though he will get visitation. She should go to Legal Aid immediately and settle custody and go to the Attorney General and settle Child Support . Actually, if they aren't married I think custody automatically goes to her, but she should get legal advice.
