Would you seek legal action?

Crazy family (with dad being a cop) is spreading vicious lies about my family - ie we are drug dealers, have domestic violence etc. I hear this from others - not directly. I am afraid with all that hatred the cop will go after one of my kids. Can I sue for harassment, libel? anything? I dont want money just to be left alone.

I guess they think making us look bad makes their child look better.

It has escalated lately.

If I retain an attorney, what kind of attorney? Criminal or civil? I fdont think a attorney who does mortgage closings is the right type??

    You best chance would be to get sworn depositions from the parties that heard any libelous statements, they would have to hear it directly from the family you spoke of or it is considered hearsay, and would not be admissible as evidence in a court proceeding. Unless you are being harassed by them either by phone, mailings, or face to face confrontations, a harassment suit wouldn't have too much merit either I'm afraid. Libel is not not a criminal matter, so you would need to obtain a attorney that specializes in civil matters. Usually you need to prove that you were damaged in some way over the libelous statements.

    Hey there, first and foremost has these allegations had a direct influence on your job, your child's environment, school, etc? If it has had some sort of influence you can absolutely take legal action.

    Secondly, allegations like these need to have evidentiary support to make them valid in any court of law. This would be a civil matter of good old fashioned feuding neighbors and I actually went through something like this when I was a teenager, and believe me it was no fun.

    Has this person put these allegations in writing? Does this family live close to you?

    Have you tried resolving this on your own?

    One ace that you have in the hole is that you know that the father in the family is a cop. What is being done to you could be considered profiling whether it's racial, religious or whatever you want to classify it as.... Police officers can get fired for profiling you see that stuff on the news all the time... as an officer of the law they are supposed to treat everyone the same....

    I suggest going straight to his superior and let that person know what is going on... does this help? Is there anymore info to this story that might help with providing an answer?

    I believe at this point you need to sit down with an attorney and ask him/her the best course of action. I believe a civil attorney is what you want, but they can always refer you to someone else if they feel someone else can handle your situation better.
