I need some advice regarding a parking fine..?
I commute to London daily for work and pay for my car park on an automated phone line. This particular day I parked at 07:00am and I could not connect to the line until 10:30am. In this time I received a parking fine. I have written to them and explained the problem and they say that I still have to pay the £25 fine!! Even though they did take the payment at 10:30am when I finally got through.
What do you think I should do?
You can either pay by phone or card and I don't carry my cards with me. It is a pay on the day car park so I couldn't pay it the day before either. Should I just pay it, pay it minus the parking that they took anyway or continue to dispute it?

I think you will be wasting your time. You could have paid it in advance, especially beings you know you park there often. I'm sure paying by phone isn't the only way to pay either.

I would advise that you do not pay the charge ,as their own system is at fault, there is also an argument for checking your payment history with this organisation. They should have these records.They should also give you an opportunity to contest the ticket, with the adjudicator. It is also worth noting that under a little known law called
the " 1689 Bill of Rights Act",all fines and forfeits without trial are illegal and void.
Also under European Law ,you have a right to a fair hearing.

I regard these people as nothing more than a bunch of criminals backed by the local authorities on the make.
However I think there is an appeals system and I would use that.
Pay the fine with a cheque marked under protest appeal pending and keep the letter refusing it for evidence of an attempt to play but appeal and get them to produce their reasons for not replying to their phone.
ask who are their service provider and a copy of all calls made at that time.and a copy of your own calls you have to prove that you have made every effort to pay on time and it is their fault that you did not. If you lose the appeal you may have to pay costs. I think that once these lying b----realise they have one hell of a fight on their hands they will back down. Use the press if you can. Having said all that it is easier to just pay the fine because it is one hell of a job trying to get sense into a jobsworth on a computer

Pay the fine.. to get them off your back.. then get on theirs by writing a series of genuine but annoying letters to complain.. thats why my dads friends got and he actually got some money and an apology letter.. as they were actually in the wrong!! :)
And remember to leave a note in the window to explain that you will be back in a couple of minutes.. in the future.. to stay in the safe side.. :)

Fight them. It's not you fault you tried to pay but you couldn't. Remember to include itemised phone bills.
If it's with the council then I doubt you will win but try anyway. If it is one of those made up parking firms like VCS ignore it because they have no right to issue fines and can just be ignored. Check out some online sites on how to fight your appeal.

when you say you could not connect why? was it engaged or did you actually connect and was put on hold coz the line was busy. if its the latter then submit a dispute with proof of you making the calls from 7am. good luck.

Pay it and the next time you cant get through, go to whoever and inform them then. They dont know the difference from you wanting to pay and couldnt get through or the next that just didnt pay.

That rather depends on who "them" and "they" are. If you are referring to the car park owners then they have no legal right to fine you.

write and complain and ask your mobile phone co to provide proof u made the calls and couldnt get thru.
