Statutory Rape laws in NY.?

My friend is an 18 year old male, his girlfriend is a 14 year old. They have been dating for several months now and she is almost 15. Is it illegal for them to be dating? There is no sex involved. Please back up your claims with valid resources. (i.e websites, encyclopedias.)

In addition, Kissing and holding hands would not be considered sexual assault or sexual fondling?

    Kissing and holding hands is safe. If they keep it innocent their relationship is fine. If they have sex after she turns 15 it's legal.

    Second-degree rape for anyone age 18 or older to engage in sexual intercourse with someone under age 15. The fact that the offender was less than four years older than the victim at the time of the act is an affirmative defense.

    Why would an 18-year-old guy want to date a 14- or 15-year-old girl? At that age the age gap can be fairly significant. When they're both older and more mature and have more life experiences to shape who they are, then the age gap won't be so noticeable.

    No, dating is allowed; but any kind of sexual contact (fondling a breast for example) would be a sexual assault on the minor, since she cannot form consent for the act.

    Any kind of sexual contact - including if she touches his genitals - will also be a criminal act BY HIM. You cannot allow a minor to touch you sexually.
