Try to make arrangements with them to pay it back. They can not garnish your wages until they take you to court and get a judgment against you.

This lawyer's threat does not sound immediately credible, but yes, if you have outstanding debts that you cannot pay, creditors can get a court order that allows them to garnish your paycheck. The amount they can garnish is limited to a certain percentage of your income, and the process takes some time to set up (weeks, maybe months). Of course, if you declare bankruptcy, they cannot touch you. But you may lose a lot more than your credit rating in the process.
