Over Time Question? I've been hired as a sales manager for a small business.?

I was told that I'd be working a 44-45 hour week (the cut off for overtime) but in reality am working between 50-55 hours a week.

My question; am I entitled to over time?

I get the impression that the boss hired me as a salaried employee specifically so he could take advantage of the Exemptions that apply to salaried workers when dealing with overtime.

I'm unclear if my job description falls under these laws or not.

I'm in NY State, if that matters.

When in the good economy time, you can demand your request,

During the bad time, it is right to secure the job available.

Don't complain and do what you can.

Take this opportunity to prove yourself to your boss and show your potential.

It is the best time to prove yourself to them.

there is nothing illegal about this, normally, if you're a salary employee. if you bring it up to your boss they might say that it should only take you 45hrs per week, but you're slow and it's taking you longer and that's not their fault. that's one of the problems being on salary. as others have said, it's up to you to decide if you want to continue working there or not, but i don't think the law provides much protection like that for salary employees.

Hmmm. I live in the UK and I am contracted to work 34 hours per week excluding breaks.

I, like you, work around 15 - 20 hours more than my contract states. Since I am salaried, I can't claim more for overtime, and my contract does state that I agree to work overtime as and when the job requires... the only problem is that it always requires the extra hours!!!
