How do we go about getting a title for the car?

My boyfriend bought a car when we lived in Florida. We moved to California, and want to get a California title. But, we were looking through the paperwork, and it turns out what we currently have an APPLICATION for the certificate of title from the state of Florida. We thought what they gave us when we got the car was the actual title. Do we need the actual title from Florida to get the California one? If so, will they give us the Florida one if we don't live there anymore? What do we do? Thanks.

Update:

Oh, sorry about that. It was bought at a dealer.

Was the car ever registered/tagged/plated in Florida in your bf's name?

If yes, then you must have a Florida title (not true of all states, but is true of FL).

So two possibilities come to mind:

    1. You lost or never received the original title: what you have to do depends on California's DMV policy. Either Cal. will require you to get a duplicate title from FL first and then you use this to get a Cal. title OR Cal. will allow you to declare on its title application that you lost the original title, provide other proof of ownership (like your current FL reg.) and Cal. DMV will handle the rest of the transfer from FL. If you need a duplicate title, download FL HSMV form 82101 and follow the instructions.

    2. You financed the car and title is in possession of the lienholder (which is standard practice in FL): Contact the Cal. DMV, they should help you retrieve the original title from the lienholder and retitle it in Cal.

It sounds like you MAY have a BIG problem (Sorry for the caps but emphasis is important) What happened was you purchased the car from a Private owner, not a dealer, right? They apparently didn't have the title and gave you an application for one, right? Lets hope that you have ALL the information about the prior owner is on this application. One really, really important Item that you will definitely need at this point is a copy of the drivers license for this owner. Without It you will get nothing and the signature on the application has to match the signature on the drivers license. You do have a problem. California will NOT get you the florida title. If you need any additional questions answered feel free to contact me.

Yes, you can sell it without a title but you need to disclose that you're seling it without a title. Whoever buys it will not be able to drive it until they get a title for it. So you might have a hard time selling it or might not get as much for it because people won't want to deal with the hassel & they may not believe you own it so they're taking a risk. So your best bet is to go to a tag agency with all the info, vin number, insurance etc & they can order a new one for you or contact the DMV
