Legal advice needed, problem with apartment complex.?

Problems started two months ago. The apartment i live sent group of maintaince guys entered my room at early 8 o'clock in the morning, and working on sort of renovation which i have no idea what it is for. The wall around entrance was tore down, and placed huge Machine to the underground, made a big hole on the celling. Whole project last about 3 days with bunch of noice and dirt. After that, i expected they would come back next day or soon to place back the wall sheets, and clean all other mess; but they never came back until today(two month after), the wall was left empty and bare, just simply covered with some boards and taped up. It was not just being cold in room. We could easily see the light come through and hear everything from neighbor. They left it that way for more than two month. Yester they sent people back without notice. First went to my neighbor, later ours room. Same disaster happens all over again. All the dirt and noise going through entire holiday. Everything in my room was covered up with plasit wrap and we have tp bear with noice and dust during holidays. We should have our friends and family come over today, but they have to stay in motel, coz there no way for anybody to stay in living room.

My husband tried talk to the property manager about compensation for all the inconvienence they have caused, we didn't get what we paid for. Their guys respond like absolutly "nothing we can do", "not my job" attitude.

Please help, any suggestion or ideas, all answers would be appreicated.

    If you want to take the time and trouble you can seek compensation in court and get it.

    I once moved into a brand new apt complex. I guess they did not install the drainage spouts correctly for the rain and it somehow would leak into the master bedroom closet. I kept getting sicker and sicker and could not find out why.

    One day I needed to get something out if the closet on the side by the exterior wall (only stored mementos on the side) and when I pulled something out I was blasted in the face with mold.

    I made them put me up in a hotel until they had cleaned everything and I mean everything including dry cleaning every item that had material. I also charged them with my doctor bills and made then deduct the rent for the days while they cleaned.

    I did not charge them with any kind of pain and suffering but I could have.

    At least insist they take off your rent every day that the apartment is not in the condition in which you rented it and signed a contract to.

    This is not legal advice, but if the problem is that bad you can start a petition and get signatures from the other tenants saying that they have a roach problem as well and that they would not object to having their apartments sprayed or treated by an exterminator. That takes away their excuse about the other tenants and then you will have some leverage to use against them if it does go to court. And roaches are actually relatively "clean" creatures so I wouldnt be too concerned about the childrens health for right now, as long as you continue to work on the problem.

    First thing read your lease... and see what right of access they define in it. Then check to make sure it's on par with your laws... as sometimes landlords will put ridiculous rights in their leases that are in violation of the law. No lease can supersede law.

    To do this...

    See if you have a local Tenant's Union... they can help clarify your

    rights in this matter.

    If not try to find an attorney that deals with real estate and see if there is some violation.

    In KY where I live a landlord must give you 48 hours WRITTEN notice before entering your domicile to do anything. Many will say we do bug spraying on the third Wednesday of every month... that serves as appropriate notice. I am sure your state has similar access laws.

    The only way they can come in unannounced in KY is if there is an emergency situation like your apt has a leak that's going into another apartment... fire... building structure problems etc.

    Law enforcement personnel are not lawyers... you need to talk to a lawyer in your area.

    I am usually against suing but this time it sounds to be the right decision. But first you need to find a different apartment, owned by a different company. You should be compensated for the added cost and inconvenience, you need to talk to the owner first, or a head of the holding company. The workers do not have any authority, go to the top. If they will not help, you need to sue.

    Take photos!! Take your landlord to small claims court for the two months rent and the hotel bill. Then make sure they let you out of your lease.

    Find another apartment. Good Luck. Don't forget those photos and take your neighbor as a witness!!

    Well you could try withholding a month's rent. Write them a letter saying because of XYZ etc. You have suffered damages and they probably violated the lease. See what it says in the lease about what they were supposed to provide. Try to be to the point and not as wordy as this question and use a spell checker, or better yet an Attorney to write it for you (Your English isn't that great)

    Get a housing lawyer, you were screwed, they had no right to do what they did in the way they did it.
