Does an ex wife get all if she is benificary on 401K and Life Insurance?
Hi All, Just wondering, My dad just Passed in Ohio, and he had divorced his ex wife, but forgot to change her name on the benificary of his Life Insurance, but not sure of his 401K. would this just be back luck for us, because we want to bring him home to Australia where he was from. but just thought we would ask, and f anyone had any ifo woud be good

The person named on the policy is the beneficiary, unless otherwise stated in a will and testament issued by your dad, dated AFTER the date the policy was signed. you would then have grounds to contest the payment of the benefit to the ex-wife

New York is the only state that I know of currently that severs life insurance beneficiary status and other contracts with joint status with a divorce and that was only recently. In New York it would go to the estate if the ex-wife is named as the only beneficiary.
I think in Ohio the money is going to the beneficiary which in this case would be his ex-wife.

Whoever is the named beneficiary on the life insurance, gets the check. Period.
Now, if he has a NEW wife, in Ohio, it could be that SHE would automatically get the 401K money. But if he was single, then yes, if the old wife is named beneficiary, she'll get that also.

Right. If he didn't change the beneficiary then the beneficiary doesn't change.
