Can I remove items attached to our post and rail fencing?

Our Neighbors have attached posts, thatching and picket fencing to our post and rail fencing on our land.This fencing divides our two pieces if land. Can I remove it personally as they are refusing . They did not ask for permission to do this.

Hi Nanny Chris actually its the other way round their dogs are always getting into our garden and always's barking. They have climbed over our fences several times to retrieve them without our permission. They were meant to pay half of the fence with us it was a verbal agreement.However because the fence is on our within our boundary I would rather not have any money from them to assist paying for it. They have also damaged our other set of fences at the top of our garden as well as these . But they won't let us examine the other side of our fence. It has already erupted into an ugly scene on their part as the woman concernred is aggressive she will not listen to reason or rhyme.

They offereed to pay part of the cost of the end section . But the money was never forthcoming. They can have time to pay this up to a 2 year perioHowever when I had menytioned it to them they had said that at the time they couldn't affoerd it . So why did they bother offering I stated there was no point in trying to get them to pay it. It isn't because they can't, they won't. their dogs are aggressive to our hens. I am so afraid one day they will get into the garden again. I keep my hens in their runs.

    If you remove it you could be at risk of making neighbourly relations go from bad to worse (and some neighbours really do go evil on you!).

    Ask them once more, explain your reasons why. Would you have objected if they asked your permission? Maybe they felt they were being overlooked by your garden and wanted extra height fences for privacy.

    If you speak to them calmly about it, you should be able to reach some kind of amicable agreement.

    If you really are dead set about the fencing they've attached and they refuse point blank to remove it - don't you remove it, instead get a solicitor to write to them ordering them to remove it. Yes, it'll cost you so you need to weigh up what you'd prefer:- Having something nailed to your fence but still get on with your neighbours. Having the panels removed and then the risk of all out war with your neighbours.

    I think the only way out now is to have someone neutral to help. A mediator. Preferably someone which both of you are familiar with. I dont think speaking to them helps since you have already turned down their offer to share the cost in the beginning as this gives them something to counter you. It may be a bit difficult for you since you have some animals of your own. Does their dog turn aggressive on your own pets?

    Depends on if the fence is on your property, or on the property line. Some areas require a fence to have a set-back onto the owners property, others don't. If the fence is on the line, you would probably need to "trespass" onto their property to remove the items.

    What a pity they didn't ask first - as it's just the right time of year to be spray painting your side in a darker shade of brown or a nice green !

    The different coloured drips will look awful on the other side and they may have have to remove the thatching and panels or paint them to match !!!

    Mind you, if it was done to keep a dog or cat of yours out then they are within their rights
