blizzard always gives a 2 week notice before the patch comes out, and the background downloader usually starts 3-4 weeks before each patch comes out, so no definantly wont be out tomorrow

The patch has been release for download to specific markets in a rollout fashion, meaning one area or country at a time. Depending on where you live the 3.1 patch should be completed shortly based on your download speeds that may very well be tonight.

Scheduled to come out in April, but you can download the preview for it which is probably what background downloader is trying to download.
