Can i sue my mechanic for doing this?

In the last month I have had my car in the shop 4 times for the same thing. i have paid a total of $1400 so far and it has happened yet again! just a little info in case it helps. My car jerked and then wouldn't shift out of first gear, i have this reader thingy to hook up to the car and it keeps showing the same code as it did the first four times. It had been running fine for a few days and now it did it again. is it possible to sue the shop for this?

it's a 2000 chrystler grand voyager the codes that pop up are P0765, P0750 and P0700

    Doesn't this dealership have a fix-it-right policy? You need to ask to speak to the General Manager or Owner. They usually hate to be troubled with customer complaints that should be resolved before they are called on. Plead your case and show them your paperwork! Ask to see THEIR version of what you paperwork is. The technician's story is on the back usually. You can also compare papers to see if notes were taken by tech and NOT relayed to you by your service advisor. Meaning, the tech saw something and notified your advisor, and the advisor FAILED to inform you of this information. Happen all the time. Especially, if they can get you back in for a few more bucks. No offense to any tech's reading this, but it happens.

    I saw you added codes. Those can be translated for you at almost any parts store or a nice mechanic with a computer.

    Good luck. Is it a misfire code? Range selector switch sound farmiliar? Sorry for the Q's, you can email more if you like.

    There is the BBB (Better Business Bureau). In which a complaint can be placed against the dealership and can show up in further investigations done by other unhappy patrons also. You may want to call the BBB and see if there are and how many already.

    Depending on year, make, model, and condition (mint usually), the ACTUAL CAR COMPANY will intervene. They usually open some sort of "investigation" as to why you were SO unhappy.

    As far as suing, I think you may have a good shot at reimbursement or partial reimbursement. Make sure to get a second opinion if possible. AND KEEP ALL PAPERWORK.

    If it is the same code for the last four times then it was there before you took it to the mechanic, he did not cause the problem, he has only not been successful in fixing it. Most all shops have you sign an estimate that basically says they are not responsable for anything, so suing would cost you even more money. Take it to a different shop, cut your losses and be sure to let everyone you know about how badly the original shop did you. by the way if you want some help with fiquring it out text me at 317-508-2987.     Confront your mechanic with your concerns yourself, or you can try to go through a lawyer. Either way I think you lose on this one. Mechanic will probably tell you to get lost and a lawyer costs a fortune. At least you learned that even someone you should be able to trust, cant be trusted. Thats a worthwhile lesson.

    In this present litigation society - you are free to sue any one for anything.

    Your problem appears to be intermittent - and if the technician can't duplicate the concern, he has no other recourse other than a best guess based on his knowledge and experience.

    If you had given more information - make, model, year, engine, fault codes received and so fourth, perhaps someone on this forum has run into this concern and could have given you a better answer.

    You wouldn't get very far by suing for incompetence...my question to you would be why did you go back 4 times and keep giving money for a problem that wasn't repaired the first time? You should have told them on the first return that they did not correct the problem, and it was their responsibility to correct it right...for the money you already paid them.

    you can sue anyone for anything at any time ,winning though is another story ,id rather have the shop repair what is causing this too happen than go to the trouble of suing them,in the end all you,ll get is your car repaired,so id talk to them and tell the that i wanted it repaired right this time or i was going to take them to court,you probably wont have a hard time getting it repaired right if you tell them this,suing people is not always the best response or action to take,good luck.

    I dont' know about suing, next time take your car to the dealer, those reader thingies don't know as much as the ones at the dealership, because they program them better.

    I don't know if its possible to sue them. the judge might not believe its there fault. my best bet would be go to a different mechanic.

    the 2nd time would be enough for me. if they did,nt fix it by the 2nd time then i would be going someplace else. sue ? i doubt that you would win because it would be your word against theirs. just find another place. you could always tell them your putting their name in the newspaper, they won,t like that. it will lose business for them.
