Should I make a claim through my car insurance company if it was the other driver's fault?
I am in Australia, the side panel of my car near the back tyre was dented by a car that was reversing back from a parking spot. Should I claim through my insurance co. or the other driver's insurance co.? Will my insurance premium be increased if I claim through my insurance co. due to other driver's fault? He gave me his name, address and phone no. and offered to pay for the damage if I get a quote from a smash repair. I am not sure what the procedure is. Thanks in advance for any help.

Get an estimate to repair the damage and call your insurance co with estimate amount and the info that the other guy gave you and ask they they "sit on this" until the other guy or his insurance pays you. Call the guy with the estimate amount and ask that he pay you ASAP. If you don't get paid, ask your insurance to file the claim for you

You should let your insurance company handle it. The other party has a legal duty to support his damages, therefore he has to supply photos, an estimate and a receipt that he repaired the vehicles. Most likely your insurance company has advised him of this, but he is disregarding it because he probably either a. didn't do the repairs or b. had no damage and just wants $1700. Even IF he does pursue you in small claims court, your insurance company will provide you with all the support you need to back up your case. DO NOT GET WORRIED. And do not give in to the taxi-cab driver, if he calls you and you answer, refer him to your insurance company. If this does go in front of a small claims court judge, and the taxi-cab driver cannot provide any documentation to support his damages and the repairs that were done - he won't get a penny. This is why you have insurance - you want them to pay what is fair. If they paid every claim that was fraudulent - insurance premiums would skyrocket. Does that make sense? good luck.

Ring your insurance company. They will ask for all the details. They will pay for the repairs and then seek to get the money back from the other driver's insurance company. Usually as the other driver has accepted responsibility for the damage you will not be asked to pay an excess.
You do not need to get a quote. Usually you will be asked to drive your car to a certain repairer that your insurance company uses so they can assess the damage and book the car in to be fixed. Your premium will not be affected as the other driver's insurance company will have to pay up.
When you are in an accident you should also get the other driver's license plate and driver's license number, and their insurance company.
Some one else who answered this question was in America and wrongly stated that you can take the money rather than getting the care fixed- in Australia this is incorrect and the care has to be repaired otherwise your insurance company will not re-insure the car.

I take it you are fully Comprehensive in which case i would go through you own company and they will claim reimbursement from the other man's company. If they succeed it will neither affect you no claims bonus or premium (you may have to pay more if a renewal is due but will get that back in the event of a successful claim against the other Co.) This is what you pay fully comp for so why have a dog and bark your self

As stated by Dale. Do you have insurance details for the other driver? If so the insurance companies will work it out. Just let them know the story. If you make a claim your premiums will go up. First stop is always the insurance company.

if the other party admits it then cliam off his insurance. you may need to inform your insurers that there has been an incident, but if its not your fault there is no need to claim on your insurance. your insurers won't care if they are not involved in the claim.
the only reason you would need to cliam on your insurance is if the other party is uninsured or denys responsibility, somethign which is difficult to do if the damaged vehicle was stationary.
get a quote urgently, go back to the person whi did the damage. if its lowish they may well swallow the bill rather than claim on thier insurance. however be prepared for him to get a shock and insist its handled by insurance (which is what its their for). if so get his insurance details and contact his insurers and tel them you hold their customer and them liable for the damage and ask them what they propose to do about it.

contact your insurance agent and tell them what has happened, they will go after the other guys insurance on your behalf for any claims you make, be them for repairs or for any personal injuries you have sustained as well as a rental car while yours is being repaired, and since this wasn't your fault I doubt that your premiums will be increased...
furthermore. you can just take the repair money and not get your car repaired if you so choose...

YOU WOULD WANT TO CONTACT THE OTHER INSURANCE COMPANY IF IT IS THE OTHER PERSON'S FAULT. THEN YOU CAN AVOID PAYING YOUR DEDUCTIBLES. IF YOU ARE HAVING TROUBLE, THEN CONTACT YOUR INSURANCE AND BITE THE BULLET ON THE DEDUCTIBLES. YOUR RATES SHOULD NOT GO UP BECAUSE IT IS NOT YOUR FAULT. THEY CANNOT CHARGE YOU FOR SOMETHING YOU DIDNT DO.
