There may be a DNA test necessary for the child to get survivor benefits. I doubt they will just allow his name to be put on the birth certificate and get the money. If it is determine that your brother was the father then that is fine. The child still can be claimed as a dependent by the AD person and receive the medical, dental, etc.. benefits but it will not be listed as his child as his name will not be on the birth certificate. Contrary to what someone else said about the child needing to be his blood relative or adopted. There is lots of children in DEERS that have no been adopted by the AD member they are considered step children and still qualify for all the benefits. But if they divorce the child in question will lose all benefits of a military child, she will also not be able to get child support from the AD member.
