The Congress shall make no law abridging the freedom of speech. But that's only the government. Plenty of other people can prevent you from speaking freely. It also doesn't say that you can say what you want to without social repercussions.

Well I don't think we have freedom of speech because you can't really say anything bad or else you might end up in jail but it really depends on the topic though.

Yes. But it has to be politically correct. It cannot offend anyone or be construed as racist or politically incorrect, especially if said by a Caucasian.

For example you can't say "Merry Christmas" at a public school or government building. You can't say a joke against any group, religion or culture. Even an elephant joke might be offensive to animal groups and is taboo as a result.
