My husband and I were stopped behind traffic and a lady on a cell phone did not stop?
There was a car in front of us, we were in a Nissan Sentra, then I look up and a full sized pickup with lady on cell phone was coming from behind. She never applied brakes. We were slammed into at 40-45 miles per hour, into the vehicle in front of us. She hit so hard that it knocked her pickup back about 20 feet.
My husband now has headaches and I am having problems with my neck from impact.
She was under insured and my insurance company has told me that they were sorry but my under insured policy was of not going to pay.
She was 100 percent at fault by police report. Her insurance company has excepted full responsibility, my car is totaled and her insurance has to pay for three cars (10000. is her amount for property damage)
Should I get a lawyer or try to settle on own.

Definitely get a lawyer,,,, 100%. Do not screw around with this. Find a lawyer that specializes in auto accidents (easy, there are a zillion of them) and get them on the case immediately.
You should be made whole, as much as possible. You could have health problems for a long time so get treated properly. Don't wait, get it taken care of ASAP.

Do no longer like that one bit,,,I could say that seems like an noticeable violation of the fourth modification however the Supreme Court has already dominated the fourth modification null and void for all functional functions, they could in general rule that that is adequate due to the fact that telephone telephones did not exist in colonial days. What precisely are they watching for besides? How does a site visitors give up justify shopping your cell files? I can pay attention the historic argument now,,,you probably have not anything to cover than you will not brain, you probably have a main issue with it, you then need to be responsible of anything.

Did your company say WHY it won't pay under the Underinsured PD coverage? This is exactly what it's for. (Insert commercial for higher-than-minimum limits here.) You need to ask your company their reason.
If you have collision coverage, it will pay after your deductible. Your company could then try to recover from the other driver and reimburse your deductible.
Other than that, a lawsuit is probably your only recourse

well if she couldnt afford insurance think she dont have any money to pay you for it sure you have to sue you need a lawyer but truth cant get money from a rock sure judgement you wil win a case but still dont mean you get money sorry yes get a lawyer
