INstrumental Copyright question?

me and my friend want to make some songs for a mixtape but, we want to use some artists instrumental beats, how would we get the rights to use those beats...

Breathe- Fabolous (instrumental)

Your all i need- Method man feat. mary j blige (instrumental)

Snitch- Akon feat obie trice (instrumental)

NBA theme song i think from NBC

OR if i put it on a non profit website for rap mixtapes like Datpiff.com??

What about if i out them on youtube,,,, and made no profit would i still then??

    using the instrumental for non profit use is fine. just make sure refer the credit to the original people who made it (if you use a fabolous beat, make sure you credit fabolous somewhere) this way, you're acknowledging that you're not trying to take credit or make money off someone else's work.

    Copyright protects both the words and the music or melody. I have written songs and recorded them accapella and then copyrighted them. My words and music [melody] are copyrighted even though there were no instruments playing.

    It is NOT legal to just sample and use other people's copyrighted material, even if it not for profit. It still violates copyright law. There are some exceptions if you don't use their recording but recreate or perform the beat yourself, and things like that. I suggest you visit the Harry Fox Agency online (harryfox.com). They handle most licensing and such for recorded works, and they have a lot of information on how to do that sort of thing legally. (Look into a "mechanical license." It might cover what you're doing and is VERY cheap.)

    If the instrumental was recorded by someone else it is copyrighted. If you're using this as a DJ, talent show, YouTube, it is extremely unlikely anyone will come after you, but they can. If anything happens, it will probably be a "cease and desist" letter from a lawyer telling you to knock it off. YouTube watchdogs are the most likely to delete your video.

    i dont think you can get the rights but it is legal to use them as long as you dont use them to get money
