Prosecution for Cannabis House?

A friend of a friend has just found out his house that he was renting out has been used as a cannabis farm.

He's been making regular checks to the house.. but not to the attic!

I was just thinking.... if he had no idea, can he still be prosecuted??

and to make it clear. the police know too.

    To be guilty of drug production you must have guilty knowledge. Full stop.

    If he has no guilty knowledge then he cannot be held accountable.

    There is an offence of allowing your premises to be used but the really important bit here is that it has to be 'knowingly'

    If your friend had no knowledge then he is not guilty.

    There are very few 'absolute' offences in the UK (that means where you don't have to have had guilty knowledge) and they mostly apply to traffic offences.

    No drugs offence is an absolute offence. Therefore to be guilty it would have to be proved that your friend knew the cannabis was being cultivated in his house.

    It depends whether the police can build a credible case against him and if the crown prosecution service decide it's in the public interest to prosecute. The onus is on the authorities to prove your friend was aware of the cannabis farm in his house.

    I think, as the legal owner, he actually does bear legal responsibility for anything illegal going on at the house.

    I doubt if the cops will push it - unless they can't find the growers to prosecute. Then they might.
