my brother is being falsely accused of sexually abuse?
About 4 years ago my brother was accused of sexually abusing his daughter in the state of Montana. He was cleared of all charges. A year ago, he was charged again on the same charges. His ex-wife is the one who accused him of molesting his daughter because she was jealous of the close relationship he had with his daughter. She lost her parental rights last month and left the state. He would never hurt her. He has never hurt her. He is a single father who has devoted his life to his child. She was molested by a male babysitter. My brother has done two psycho-sexual evaluations and they have both proven him innocent, yet they are still going to put him through a trial. His attorney says he should just plead guilty. What should he do. He feels so hopeless yet I know he is innocent.
He is not being offered a deal. They just want to try him and put him away for 25 years. They have already taken my niece and put her in foster care. He has not seen her since November of 2008. Is there anyone out there that has been falsely accused and how did you prove your innocence?

why on earth would he plead guilty?!
the state will just take his daughter
he needs to get a better lawyer and fight the power!

Is his attorney telling him to plead guilty because he is being offered a deal? If not it is very poor counsel and you should definitely get a new lawyer. How old is the daughter? If she says he didn't abuse her and there is no other proof or witnesses to any abuse then no jury will ever convict him.

I agree with the answer: get a better lawyer..if he is innocent than he stands his ground..and proves that this male babysitter is the molester and the guilty party..

psycho-sexual evaluations don't prove one's innocence or guilt to sexual abuse..... just how well they do on the evaluation!
If he's not guilty... then he shouldn't plead it. He should hope the truth prevails..... because it usually does... but not always!!!!
