What am i entitled to?

I am a 17 year old female who works one day a week (8am-6pm) in a busy news agents with a 9 hour contract at 3.53 per hour.

I receive one hour of dinner which i can take all at once or 30 minutes and two 15 minutes unpaid which is my only break within the day.

I have 43 hours paid holiday in total.

I am unsure as to whether the break time i get is correct and whether I should be entitled to more holiday and if i should receive sick pay.

Also we only get paid utill 6pm, this means we have to tidy the shop, sweep and mop and do the cig count in half an hour. If it takes longer we do not get paid for this time and are unable to leave. I have been there untill 6.45 before to get it finished and the extra pay was denied. my employers argument is that it should only take the amout of time allocated.

I appreciate any answers as to whether what i am recieving is correct and if not, what would be the correct action to take.

many thanks

I am sure it is law that when you are scheduled to work a 9 hour shift it actually means you are working 8 with a half hour lunch and 2 15 minute breaks.

Alot of places don't give vacation and sick pay and if they do, may be a requirement to have X amount of hours to qualify.

As for staying past your shift, do you clock in and out? If you do then your time is documented (so you have proof) and you can take it to L & I (Labor & Industry) if they refuse to pay you for your time on the job. Maybe what they are saying to you is that you need to manage your time cleaning up. Maybe learning to multi task so not to backtrack would help. Have you asked them to give you some guidance, they may feel you are worth their time if you seem to care about your job performance.

You are sort of in a CATCH 22. Make waves and you may be let go, but mind you they have to have a pretty good reason anymore.

One last thing...was $3.53 a type-O? Seriously, isn't your min. wage more than that???

Sure hope I was able to help.

Go onto the acas website www.acas.org.uk or call them 08457 474747, as u r under 18 u have special rules that apply to u, if the above doesnt work u can go onto askcab.org.uk they are with the citizens advice bureau and its a dedicated site for under 25's- that or contact ur local CAB. Sorry i couldnt help more.

Just to mention if u do want to put in grievance there is a 3 month time limit for taking it to employment tribunal if uve identified u have a case make sure ur within this time limit. Also when contacting any of the above its handy to have ur contract within reach:)

I'm not sure where you live, but I don't want to give you the wrong info.

Call the Labor Board in the city you live in and they can give you the right information and help with any work related problems you have.
