This depends on if you are the owner or a tenant.
The owner does not get much notice. It can be as little as a week, and yes they have to give you some kind of notice. You know you have not been paying and should be preparing to move.
A tenant typically does not know until they get the notice of foreclosure. The new law requires banks to let you stay till your lease is up or give you 90 days notice.

Are you a tenant or the owner? Both of you will get notice when the house is in foreclosure. Most likely you will be named in the foreclosure in an attempt to evict you at the same time the property changes hands. You will need an attorney to defend you if you are named.
