Problem with my auto ins company.?

Ok. first of all i own a 2000 dodge neon. Not in bad shape, but it has 140,000 miles. I plan on keeping it till it falls apart. In June i was sideswiped my a lady from another state. the damage was contained to the front drivers side. Above the tire. The car was drivable.

she begged me to not call the police, but i did so i could have a accident report. Than i called her INS company. Was told to to get an estimate. I did, they found her at fault and since i owned the car outright..they sent a check made out to me.. was told there was no need to talk to my own ins company since i did not make a claim with them. However the other driver called them. My ins company called me this week to tell me they wanted to look at my car. I told them it was not fixed and since it was a minor thing..i was not going to put the money into the car. the agent got mad and told me i HAVE to fix the car. what do i do next? thanks

I have no problem with letting them see the damage. I can understand that they do not want me to come back and make a claim,but they are going too far.

    Your insurance company can not tell you how to spend money you get from another insurance company.

    Most likely you have one of those companies that advertise onTV" We insure anyone" , we have lowest rates, we have the cutest gimmick, etc.

    You could take the insurance money and your car and get a newer car.

    If the other insurance company wanted to make sure the money got used to repair your car, they would have made the check out to you and a body shop/ repair facility.

    several good answers here..

    1. since you own the car outright, you do NOT have to have your vehicle fixed.

    2. however, since you choose not to have the damages repaired any accidents you have in which there is damage to that same are they would not owe for again or they would take a deduction. same would apply if your vehilce was not repairable, a deduction would be taken.

    3. sounds like the other driver called your insurance to try and put in a claim. They do have a right to view the vehicle so they can complete their investigation.

    4. read your policy. Under DUTIES AFTER AN ACCIDENT OR LOSS there is a phrase that ALL claims must be reported regardless of fault. Now, I realize of course many people choose not to do this but this is one of the many reasons why you should do it.

    Nonsense, you don't have to have it fixed. Find another insurance company.

    As for prior damage as a reason to deny a claim, that just sounds like an insurance company trying to avoid a payout, which is what they try to do.

    I suppose they think if there was no damage to a fender before it was hit, then there would be no new damage?

    You tell your agent that the condition of your car is not something they need to look at since they didn't pay anything out on your losses. And that you didn't make any claim with them, so it is really not their concern. If they can't accept that as gospel, start looking for an agent that has a bit more sense, and switch.

    Get your car fixed. If you don't and get into another accident they will try to call as much of the damage as they preexisting damage and refuse to pay for it. For example I have a friend who had a paint chip off his car fender you could cover with a half dollar. He had a fender bender on that side of the car and they call it pre existing damage and cut $250 off the settlement. Next time call your insurance company they should handle it for you and deal with the other guys company.

    Simple answer: You can keep the money, let the baboon look at your car and if he tells you to repair it tell him to go pound sand.

    They might deny you coverage though.

    You DO NOT have to have the car repaired. Your insurance is afraid that they will have to pay again to repair the same damage. Tell them to shove it. They can easily note the existing damage in your file. Ask them to do just that.

    great lesson to learn. always follow the rules and laws of your state & communicate with your insurance company right away.
