Is it illegal to put out-of-print books on the Internet? How about just excerpts from out-of-print books?

You need the permission of the author or his heirs.

Unless the book is older than 1923.

If the book is still in copyright, then yes, it is illegal to upload the text of it to the Internet. Google tried it and got sued.

You may be OK with an excerpt - this might qualify as "fair use" or "fair dealing". Check the law where you live.

If the book is out of copyright (public domain), then do whatever you want with it.

  • Of course it is. Just because something is out of print, gives you no new rights to that work.

Unless you have millions like google, the rules still apply.
