Kansas Traffic Ticket from 9 years ago - Do I have a chance??!!?
I am going to court this month for a speeding ticket and no proof of insurance from 9 years ago. I didn't realize it wasn't taken care of until I went to renew my license. I have been trying for months to get proof I had insurance at the time but due to it being so long ago and not having the policy number my insurance is having a hard time finding the info. I have tried getting an old police report from a wreck but they cant find a copy of that either...long story short I have tried at least 5-10 diff. ways of getting proof and all have been a dead-end! My questions are this :
1. Can I still plead "not guilty" to the no insurance even though I have no proof otherwise?
2. If I plead not guilty will they set a diff. court date?
3. Are their lawyers present at municipal court to advise you?
4. They have doubled the fines since I didn't pay originally - does anyone know what my chances are that the judge will cut them back down to the original amount?
5. If I plead not guilty, does the ticketing officer have to show up and if he doesn't would it be grounds to throw all of it out even from that long ago?

My insurance company "can't find it". Now I may be mistaken on who the Insurance company was at that time but by no means would I come onto Yahoo and give an excuse when I am truly asking for help!

I found the police report from the wreck but the Insurance on the report wasn't the same Insurance I had at the time of the speeding ticket. I have tried multiple companies and can't find proof - even though I am 100% confident I had it at the time. I am going to speak with the Prosecutor on my court date, give him an affadvit that I have and all other supporting docs and truly just be at the mercy of the courts...with the money as I am sure I will still have to pay.
Guess this is what I get for forgetting to pay it to start out with!!

When you failed to appear for your original court date 9 years ago you were found guilty of both speeding and driving without insurance. The time to plead not guilty has passed.
No you are dealing with a warrant for failure to appear or pay as promised. The remedy for that is to pay the fines and additional interest.

If it is simply a traffic ticket than it is a civil violation, not a criminal charge. The differences are...
1. Civil charges have no possibility of jail time. Thus, you are not entitled to a lawyer, so I doubt any will be available.
2. When someone fails to appear on a criminal charge, a warrant is issued to bring them back and answer to the criminal charge in court. When some fails to appear on a civil violation, you are found guilty and a fine is assessed. If you fail to pay the fine, you face either a bench warrant and/or license suspension.
3. The court will not hold the case for 9 years on a civil traffic ticket. They have already found you guilty by your failing to show up. If no insurance is a criminal offense in Kansas, you will still have a trial, but I am sure a warrant has been out for 9 years.

1) Get the date of the violation off the ticket.
2) Figure out who(m) you were insured through at that time.
3) They can do a research, against a certain year, on insurance, if a date is given.
*** I am confused, as you say, a wreck, was this also a portion of that other company.
Lets say it was, and was settled out of court, the insurance company will have a record of payment made to whomever.

"My insurance can't find the info" is not a valid excuse. If you were insured, you're insurance would be able to find it easily - they have all kinds of legal issues they're dealing with - if they couldn't find someone's record they'd be out of business. Better get a better excuse than that because it won't fly.
